FashionistaPics is an Internet service (the “Services”) that allows users to create community around fashion. By accessing or using any of the Services associated with or provided, you expressly agree to be bound by the following terms and conditions of these Terms of Services. Use of Services

Use of the Services is limited to non-commercial, personal and private use only. Any use for commercial gain is expressly prohibited.

You agree to be solely responsible for any authorized or unauthorized access to your account by any person. You represent and warrant to FashionistaPics that:

You are over the age of thirteen (13), have the power and authority to comply with the terms of these Terms of Services and to perform your obligations under the terms of these Terms of Service;

You will comply with all terms and conditions of these Terms of Service; and

•

You have provided and will provide accurate and complete registration information.

Each time you upload a file on FashionistaPics, you represent and warrant that you own or otherwise control the rights or have the necessary consents to do so, and you grant every other FashionistaPics user the right to download and use such file.

You expressly agree that you are solely responsible for any and all acts and omissions that occur under your account or password, and you agree not to engage in unacceptable use of the Service, which includes, without limitation, use of the Services to:

Interfere, disrupt or attempt to gain unauthorized access to other accounts on the Services or any other computer network;

•

Disseminate, store or transmit viruses, trojan horses or other malicious code or program; or

•

Engage in any other activity deemed by FashionistaPics to be in conflict with the spirit of these Terms of Services.

You acknowledge and agree that from time to time the Services may be inaccessible or inoperable for any reason, including, without limitation:

•

Equipment malfunctions;

•

Periodic maintenance procedures or repairs which FashionistaPics may undertake from time to time; or

•

Causes beyond the control of FashionistaPics or which are not reasonably foreseeable by FashionistaPics.

You may engage in conferences, download and upload files and otherwise use the Services as permitted by these Terms of Service and applicable law. Files that you upload, public messages that you send and your activity in conferences are subject to review, modification and deletion without notice by the manager responsible for the FashionistaPics area where you’re uploading or other activity takes place (or by an individual designated by such manager for such purpose). Files uploaded to a BBS may be subject to posted limitations on usage, reproduction and/or dissemination, and you are responsible for adhering to such limitations if you download them.

You are responsible for your communications and your use of the Services. As such, you may not, under any circumstances, do any of the following:

Post or transmit any message which is libelous or defamatory;

•

Post or transmit any message, data, image or program which is obscene or pornographic;

•

Post or transmit any message, data, image or program that would violate the property rights of others, including unauthorized copyrighted text, images or programs, trade secrets or other confidential proprietary information, and trademarks or service marks used in an infringing fashion;

•

Use the Services to threaten, harass, stalk, abuse, or otherwise violate the legal rights (including rights of privacy and publicity) of others;

•

Upload or download files that contain software or other material protected by intellectual property laws, rights of privacy or publicity, or any other applicable law unless you own or control the rights to such files or have received all necessary consents;

•

Upload files that contain a virus or corrupted data;

•

Delete any author attributions, legal notices or proprietary designations or labels in a file that you upload through the Services;

•

Falsify the source or origin of software or other material contained in a file that you upload to FashionistaPics;

•

Falsely purport to be an employee or agent of FashionistaPics;

•

Cause repeated disruptive incidents;

•

Act, or fail to act, in your use of Services, in a manner that is contrary to applicable law or regulation; or

•

Engage in any other activity deemed by the FashionistaPics to be in conflict with the spirit or intent of this Agreement.

You are entitled to use the contents made available on the website for your own purposes. In particular, you are not entitled to pass on the contents or parts of the contents to third parties, to provide or enable third parties access to the contents for free nor for a fee or to sell the contents to third parties without the written consent of FashionistaPics.

All contents and services which are made available on the website and to which yo are granted access are protected by industrial property rights (in particular copyrights, trademark and patent laws or other rights) and other statutory regulations and may only be used in the manner approved by FashionistaPics in these Terms of Service. Copying, publishing or application - also in part - of the contents made available in other electronic or in printed publications is not permitted without the written consent from FashionistaPics. You are not entitled to alter or remove copyright notices, trademarks or similar information in the contents.
